Please read these Terms carefully before using our services. These govern referrals, IOD claim handling, and use of our online products.

1. Agreement to Terms

By accessing or using our website, mobile applications or services ("Service"), you agree to these Terms, our Privacy & POPIA Notice and any other policies posted on the Site. If you do not agree, do not use the Service.

2. Our Services

Novelmed provides IOD referral intake, claim submission, tracking, reporting and related administrative services. We act as a service provider facilitating communication between employers, claimants, treating clinicians and compensation bodies.

3. User Responsibilities

  • Provide accurate and complete information when submitting referrals or claims.
  • Ensure you have lawful authority to submit personal information (including employee or patient data) and comply with POPIA and applicable laws.
  • Keep account credentials secure and notify us immediately of any unauthorized access.

4. IOD Referrals and Medical Information

When referring patients or submitting case documents you must only provide the minimum necessary personal and medical information required to perform the service. Medical or special category data should be provided by authorised clinicians where necessary. We process such data in accordance with our Privacy & POPIA Notice.

5. Intellectual Property

All content, branding and software provided as part of the Service are the property of Novelmed or our licensors. You may not copy, reproduce, or distribute our proprietary materials without prior written permission.

6. Limitations and Disclaimers

Our Service assists with administrative and facilitation tasks. We do not provide medical diagnoses or clinical treatment. Any clinical recommendations are provided by qualified clinicians. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all warranties, whether express or implied.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Novelmed and its affiliates will not be liable for indirect, incidental, special, consequential or punitive damages arising out of or in connection with the Service. Our aggregate liability for any claim shall not exceed the fees paid by you to us in the preceding 12 months (if any).

8. POPIA and Data Protection

We take data protection seriously. Processing of personal information is governed by our Privacy & POPIA Notice. By using the Service you consent to the processing described in that notice where permitted. We implement reasonable technical and organisational measures to protect personal data.

9. Termination

We may suspend or terminate access to the Service for users who breach these Terms, misuse the Service, or where required for legal or security reasons. Termination does not affect rights or liabilities accrued prior to termination.

10. Third-Party Services

The Service may integrate with third-party platforms (APIs, compensation bodies, email/SMS/WhatsApp gateways). Use of third-party services is subject to their terms and we are not responsible for third-party actions or policies.

11. Changes to Terms

We may revise these Terms from time to time. We will publish the updated Terms on this page with a revised "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the South African courts, unless otherwise agreed in writing.
